Truck catches fire on Massachusetts Pike

Massachusetts State Police responded recently to an accident on the Massachusetts Turnpike in Otis, involving a tractor trailer which jackknifed and caught fire. Police closed the highway in the immediate aftermath of the accident, but both lanes were reopened within the hour. Despite this quick response, the Pike was backed up for 6 miles. In a happy turn of events, it appears that no other cars were involved in the accident, and that nobody was seriously injured in the fiery accident.

Even though nobody was injured, this accident just goes to show that truck accidents can happen, and they often cause tremendous wreckage when they do. It pays to be cautious when driving around large trucks, but sometimes that is not enough, and an accident will occur. If you or a loved one is injured in a truck accident, it is important to remember your rights. Depending on who was at fault in the accident, you could be entitled to compensation for any injuries or damages you suffer.

There are a lot of legal complexities surrounding a truck accident, including the condition of the truck and its driver as well as the practices of the company that owns that truck. For this reason, it can be difficult to prove fault in a truck accident case. However, we pride ourselves on using creative and innovative methods to prove fault and get our clients that compensation they deserve.

If you or a loved one has been in a truck accident, you will likely have unexpected bills to pay. Repairs to your car, medical bills or in the worst case funeral bills will begin to pile up leaving you little time for grief. Fortunately, a successful lawsuit can grant you the compensation you deserve and alleviate financial stress, so you can focus on recovering from your emotional stress.

With the increase in both recreational and commuter cyclists on the city’s roads, it is obvious that there will be an increase in the number of injuries and fatalities reported, as well. Recent statistics suggest that the current bicycle crash rate is one crash per 1,030 miles, and 37 percent of all bicycle crashes involve a car.

Cyclist Killed by Dump Truck

According to Boston CBS Local, a cyclist died after being hit by a truck in the suburb of Wrentham. According to the article, the accident occurred at a busy intersection in the early evening, and police suspect that it was the result of the cyclist being blinded by a solar glare. Investigators believe the cyclist turned in front of the truck, which was travelling in the opposite direction, and the driver was unable to avoid the cyclist.

After striking the cyclist, the truck veered off the road and into the nearby forest. It sheared off an entire telephone pole before coming to a stop. The truck driver called 911, and local police responded shortly after. The driver of the truck was uninjured; however, the cyclist was declared dead on the scene.

According to locals, the stretch of road is a common accident zone. Still, police are investigating the truck for abnormalities or faults before making any conclusions.

Bicycle Fatalities on the Rise

The Boston Globe reports that there has been a marked increase in bicycle-related accidents in the greater Boston region, particularly in the city’s suburbs.

According to the article, cycling collisions in Boston’s suburbs have nearly tripled. Of these accidents, approximately 70 percent resulted in injuries. The article suggests that the increase is a result in the enthusiastic uptake of cycling as a means of transport in the state, which has been widely encouraged by local government officials.

Local cyclists and activists are now calling for more safety measures to be introduced to curb the increase in accidents and injuries. However, it is believed that a combination of speed, congestion and an increase in numbers are behind the heightened risk that cyclists face on the city roads.

Injuries obtained as a result of a cycling accident can be serious and debilitating, and extremely costly to treat. If you have been involved in an accident, a personal-injury attorney might be able to help you recover damages. A personal-injury lawyer will work with you directly to assess your situation and establish the best way to proceed. Call us today at 617-698-6000 to schedule an appointment.

An overview of nursing home negligence

Nursing homes are sometimes the best alternative for an aging loved one who can no longer live self-sufficiently. However, we have previously mentioned the dangers of nursing home negligence and what you can do to hold the nursing home responsible for its behavior if this becomes an unfortunate reality for your loved one. However, we understand that it can be difficult to tell just when you have a possible case of negligence on your hands. If an elderly loved one develops an illness or health complication while in the care of a nursing home, it is not unreasonable to feel grief and blame the nursing home for not doing their best to care for the patient, but it is important to remember that it is not always their fault.

Elderly people are more prone to injury or sickness; that is usually why we put them in care facilities in the first place. Any number of unavoidable health issues can crop up and afflict our loved ones, but in many cases there is nothing that the nursing home can do except ease the patient’s suffering. Still, there are a few ways to tell if a nursing home has been negligent in its care.

Generally speaking, if you can prove that an employee of the nursing home failed in their duty to provide care and this failure directly caused an injury in the patient, you could hold the nursing home responsible for your loved one’s injuries. It could be even more simple than proving negligence. For example, in some cases, nursing home employees actively abuse patients, either sexually, physically or psychologically.

If you believe that you have a nursing home negligence claim on your hands, consider that the laws of your state might be different than the laws of another state. Massachusetts residents are encouraged to meet with an attorney who is familiar handling such cases in Massachusetts. Not only will this help you determine if you have a strong claim on your hands, it can ensure that you receive the maximum compensation from your claim.

Motorcycle Accidents in Massachusetts

If you ride a motorcycle, you are more at risk of serious injury or death than if you are in a vehicle. A study conducted by the Centers for Disease Control and Prevention between 2001 and 2008 reveals alarming figures. During this time period, more than 34,000 motorcyclists were killed in the United States as a result of a crash, with the highest death rates among 20- to 24-year-olds. The number of injuries incurred as a result of motorcycle accidents was significantly higher, with an estimated 1,222,000 individuals treated for non-fatal injuries from motorcycle accidents.

Many of these accidents are not the fault of the motorcyclists themselves. The risk of injury is a reality that most motorcycle drivers accept, but if you have been involved in an accident and have suffered serious injuries as a result, Colucci, Collucci, Marcus & Flavin P.C. wants to hear from you. If a car or truck driver has acted negligently and caused you to be involved in an accident, we will defend your rights and seek compensation. Deadly Motorcycle Accident on Massachusetts Road

WWLP reports that a section of Route 5 was closed after a serious accident involving a car, motorcycle and SUV. According to the report, the accident took place late on Friday night on Northampton Street close to the intersection with Vadnais Street, and parts of the road had to be closed to allow emergency services and accident investigation teams to attend to the scene.

The investigation into the incident is ongoing; however, eye witnesses report seeing the mangled wreckage of the three vehicles and at least one dead body. Another victim was seen being loaded into the back of an ambulance.

Injury on another person’s property could mean compensation

It may seem extreme to file a lawsuit against somebody because you slipped and fell on their property, but depending on the severity of the injuries you suffer, it may be your only feasible option. Many slip-and-fall injuries result in minor scrapes or bruises, but it’s not uncommon for serious accidents to occur. For example, if you fall too hard, your head might end up striking the floor, which could result in a concussion or serious brain injury.

Such an injury could require medical attention that you can’t afford or prevent you from earning the wages you need to maintain your lifestyle. In a case like this, a successful premises liability lawsuit could be the difference between getting the help you need and now figuratively falling again, this time into a financial hole, just to get well. You may not want to file a lawsuit against the property owner, but you may be left with no real alternative.

Premises liability could apply to a number of issues beyond just slipping and falling. Any case in which you have suffered an injury due to a property owner’s negligence is potential grounds for a successful claim. This can include defective smoke detectors, dog bites or even accidents at amusement parks. For a more comprehensive list of premises liability concerns, as well as information on how we can help you with a claim, visit our web page.

A premises liability lawsuit offers you a legal form of recourse in the event that another person’s negligence causes you a serious, potentially life-changing injury. The compensation you receive from a successful premises liability lawsuit will make sure you don’t lose your financial footing, and ensure that you can focus on recovering from your injury.

Mother of Teen Killed by Car During Police Confrontation Receives Compensation

The mother of teenager Delano Walker has received $1.3 million in compensation following a wrongful-death lawsuit. According to Mass Live, the teenager was struck by a vehicle while in a confrontation with law enforcement. Eye witnesses claim a police officer grabbed Walker’s throat, and as he spun to avoid the confrontation, he ended up in the path of an oncoming vehicle.

Police testified that Walker was combative and resistant to their attempts to get him to cease a phone call. However, after seven hours of deliberations in the court case, it was determined that the officer had violated the young man’s rights. The original suit filed by the teenager’s mother cited violations of his civil rights, the use of excessive force, reckless intent, assault and wrongful death.

Massachusetts Family Suing Government for Wrongful Death

In a landmark case, a local Massachusetts family is suing the government for the death of their son, a Central Intelligence Agency (CIA) contractor who was killed in Benghazi, Libya. According to NECN, the family is seeking $2 million in damages from the CIA and state department, alleging that there was inadequate security at the United States diplomatic post and at the CIA compound when it came under attack in 2012.

At this stage, the state and the CIA have declined to comment, but the family has said they have tried repeatedly to reach out to the government to reach a resolution. According to the family, legal action was the only possible way to resolve what they believe to be a wrongful death that resulted from the negligence of these organizations.

Massachusetts bicyclist killed in truck accident

Most of the talk around truck accidents covers the impact that the massive vehicles can have when they collide with smaller cars. Amongst all of this, we sometimes neglect the possibility that large trucks are just as capable of striking bicycles or pedestrians. Considering the substantial damage that cars and drivers might suffer in a truck accident, pedestrians and cyclists are lucky to survive the accident at all. Unfortunately for one Massachusetts man who was cycling in Wrentham, he was not lucky enough.

The accident occurred recently on a Saturday evening as the cyclist was attempting to make a left turn. Police are currently investigating the accident, but they believe it?s possible that the victim was blinded by the sun before taking the turn. A dump truck struck the cyclist before veering off the road and smashing into a tree. Police intend to inspect the truck to ensure that it was not suffering from mechanical issues.

In the wake of a truck accident, it is vital to inspect the truck in such a way, since a truck being in a state of disrepair could mean liability for the owner of the truck. Trucking companies have a responsibility to ensure that their trucks and the people they hire to drive them are in optimal operating conditions at all times. If it is discovered, for example, that the truck in this accident had a known brake issue, and the trucking company did not have the issue repaired, they could be liable for this bicyclist?s death.

If you or a loved one has been injured in a truck accident and you believe that the truck or its driver was at fault, you could be entitled to compensation. Consider speaking with an attorney to help you build a solid case to bring before the courts. You don?t have to suffer because of a truck company?s negligence.

Motor vehicle accidents are principal causes of serious injuries and deaths in the United States. Teen Dies in Horrifying Accident

A 17-year-old teenager has died in a horrific early-morning accident, according to a report on Boston.com. It appears that the teenager’s vehicle was the only one on the scene when local police and the fire department arrived at 7 a.m. The victim, who has yet to be officially identified, was rushed to the nearby Lahey Hospital and Medical Center, where he was pronounced dead.

Preliminary reports indicate that the driver left the roadway and crashed into a tree. The investigation into the accident is ongoing.

Two Girls Struck By Vehicle

In a separate road traffic incident in Boston, two young girls were hit by a vehicle near a bus stop, according to a report by NECN. The incident involved an 11-year-old and a 13-year-old, and both were taken to nearby hospitals by helicopter and ambulance respectively. They were treated for serious injuries.

An investigation into the incident continues, but police officials suggest that a Dodge Ram Truck was involved. It appears that the truck struck the two girls while they were crossing the street, but a full investigation is still being conducted by local and state police.

Community residents suggest that the intersection is a dangerous one, and there have been many close calls of a similar nature in the past. Particularly problematic is the solar glare that appears while travelling early in the morning. Residents are urging authorities to take measures to prevent similar accidents from occurring in the future.

Although the report did not provide enough information to determine if negligence played a role in this case, the victims may end up filing a personal-injury lawsuit. This could help offset the medical bills their parents now face due to injuries sustained from the accident.

If you need a personal-injury attorney or assistance with a matter relating to vehicle accidents, then Colucci, Colluci, Marcus & Flavin P.C. can help.
