How Safe Are Your Children at Daycare?

Having a career with a family only works with adequate child care. Our little ones are the most important people in our life. We cannot concentrate at work if we are busy worrying about their safety. When we look for daycare, we try to find one that friends have used, has excellent reviews, great safety ratings, and great word of mouth. Unfortunately, even with all our due diligence, we might get it wrong.

With a year spent in a pandemic, many inspections and wellness checks have been done virtually. Unfortunately, critical safety violations were missed at a local daycare where a fire broke out, severely burning a toddler.

If you or someone you love has a child who was injured at daycare, you need a daycare injury lawyer in Boston, Massachusetts. The nationally recognized trial lawyers at Colucci, Colucci & Marcus, P.C. have extensive experience in daycare injury cases. Call us today.

An Investigation is Ongoing

The nightmare is very real. A severe fire broke out at an Oxford daycare, burning a young toddler. He was found on the floor of a bedroom in front of a playpen with second-and three-degree burns. While the adults were able to put the fire out, an investigation into criminal neglect is ongoing. The young boy is currently recovering at Shriners in Boston.

The daycare had passed a virtual inspection. However, during a new monitoring visit, the facility was found to be non-compliant with several regulations.

  • Lotions, powder, and other hazardous items were accessible in the bedroom
  • There was clutter in the kitchen, bedroom, and dining room table
  • An infant napped in an unlicensed bedroom
  • The television in the living room was not secured to the wall or furniture
  • There was a person on the premises who had not gone through a background check.

According to Child Care Aware of America, there is no reporting system that tracks child deaths or injuries at a childcare facility. With 11 million children in child care programs, fatalities and injuries largely remain a private matter.

Boston Daycare Negligence Lawyers

Colucci, Colucci & Marcus, P.C. will hold negligent daycares responsible for your child’s injury. Children are the most important people in our lives and deserve the protection and caring purported by daycare providers. When they fail, and your child is hurt, there is no excuse. Daycare negligence injuries are:

  • Falls, usually from a high point like a monkey bar or down a set of stairs
  • Choking or swallowing small objects
  • Physical, verbal, or sexual abuse
  • Any harm or injury from another child
  • Broken bones or fractures

Young children are not able to explain that they were hurt or how they were hurt. As a parent, you may notice bruising, strange stories, especially in the treatment of others, or pictures. Children often draw the things that bother them. Talk to your child about their artwork. A seemingly harmless picture could reveal secrets your child didn’t know they were keeping.

A picture of themselves at daycare could show little bottles in the background. Ask what it is. Your child could be drawing hazardous cleaning chemicals left within reach. A picture could show one of their playmates away from the other children but close with a daycare worker that doesn’t seem right. Ask questions. Your child might unknowingly be picking up on the abuse of another child.
